
TERMS AND CONDITIONS OF USE

Welcome to MOX Networks SpA (hereinafter, "MOX", "we", "us" or "our"). These Terms and Conditions of Use (hereinafter, the "Terms") regulate the access and use of all the services that MOX offers through its website https://mox.cl, https://mox.one and its subdomains, including but not limited to VPS services, dedicated servers, VPN, web hosting, domain registration, proxies, software development and any other additional services that may be incorporated.
Use of our services implies full acceptance of these Terms. If you do not agree with any of them, you should refrain from using our services.
1. DEFINITIONS
- - Client or User: Any natural or legal person who contracts, accesses, or uses our services.
- - Control Panel: Online platform through which the Client manages their contracted services.
- - Client Content: Any data, file, software, information, multimedia content, or code uploaded, stored, transmitted, or processed by the Client in our services.
- - Services: Any service provided by MOX, including free or paid services.
2. ACCEPTANCE AND MODIFICATION OF THE TERMS
The Client acknowledges that use of the Services implies express and irrevocable acceptance of these Terms. MOX reserves the right to modify these Terms at any time. Modifications will be notified on the website or by email. Continued use of the Services after the modification constitutes acceptance.
3. CUSTOMER REGISTRATION AND OBLIGATIONS
To use the Services, the Customer must register by providing accurate, up-to-date, and complete information. The Customer is responsible for maintaining the confidentiality of their access credentials and for all activities conducted under their account.
The Client agrees to:
- - Not to use the Services for illegal purposes.
- - Not to violate intellectual property rights.
- - Not to compromise the security or integrity of MOX's infrastructure.
- - Not to use automated software to interact with the Services without prior authorization.
- - The Customer declares that they have read and accepted the Acceptable Use Policy (AUP), available at https://mox.cl/legal/politica-uso-aceptable.
4. AVAILABILITY AND SERVICE LEVELS
MOX is committed to providing high availability of its Services, except for scheduled interruptions for maintenance or force majeure. Some services may be subject to specific service level agreements (SLAs), available upon request or on the customer portal.
MOX does not guarantee the uninterrupted or error-free operation of the Services, although it will use all reasonable measures to ensure their stability and continuity.
5. ACCEPTABLE USE AND PROHIBITED CONDUCT
The Customer agrees to comply with the Acceptable Use Policy (AUP), including:
- - Not to send spam.
- - Not to store or transmit illegal content (child pornography, terrorism, phishing, malware).
- - Not to use proxies or VPNs for prohibited activities.
- - Not to negatively affect other customers by overusing shared resources.
MOX reserves the right to suspend or cancel services without prior notice for prohibited conduct.
6. PAYMENT, RENEWAL AND REFUNDS
Services are billed automatically and in advance according to the contracted cycle. In the event of non-payment, services may be suspended or terminated after defined grace periods.
Refund Policies:
- - Some services may include money-back guarantees.
- - Custom services, development, or licensing are non-refundable.
- - No refunds are given for suspension due to misuse.
7. INTELLECTUAL PROPERTY AND LICENSES
All content and software developed by MOX is the exclusive property of MOX or its licensors. The Client does not acquire any rights to the software beyond limited use in accordance with the contracted service.
The Client retains ownership of its content, but grants MOX a limited license to host, transmit, and process such content as necessary to provide the service.
8. LIABILITY AND LIMITATIONS
MOX will not be liable for:
- - Loss of data not backed up by the Client.
- - Damage resulting from misuse of the services.
- - Malware infections, attacks, or loss of access due to compromised passwords.
- - Errors made by the Client or third parties in the configuration of the services.
MOX's total liability for any claim will not exceed the amount paid by the Client in the last 3 months for the service in question.
9. CONFIDENTIALITY AND DATA PROTECTION
MOX will process the Client's data in accordance with its Privacy Policy. MOX is committed to implementing technical and organizational security measures to protect personal data. In the case of commissioned processing, a Data Processing Agreement (DPA) must be signed.
10. DURATION AND TERMINATION
The contract is considered valid as long as the Client maintains active services or does not expressly request its cancellation. MOX may terminate the relationship in the event of a serious breach of these Terms.
In the event of termination:
- - The Client must download its data before the termination.
- - MOX will delete the content after a reasonable period.
11. APPLICABLE LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of Chile. Any dispute will be resolved by the ordinary courts of justice with jurisdiction in the city of Santiago, unless expressly agreed otherwise.
12. DISCLAIMER
MOX® will not be liable for the actions or omissions of users who violate this Acceptable Use Policy or any applicable legal regulations. Misuse of contracted services is the sole responsibility of the account holder. Under no circumstances will MOX be liable for damages, losses, or penalties arising from illegal, abusive, or activities contrary to this policy carried out by the user or by third parties using their credentials or infrastructure.
